Vero Volley Monza-Cisterna, Lombard club’s appeal dismissed

The Superleague Volleyball Sporting Judge has rejected Vero Volley Monza’s appeal filed after the 2-3 against Cisterna last November 8. This was announced by the Volleyball League Serie A on Wednesday, thus confirming the result on Saturday’s field, which awarded the white-and-blue club.

Vero Volleyball had filed an appeal to challenge the referee’s acceptance of a video-check request by Cisterna, regarding an alleged foul invasion during the tie-break on the score of 13-14. the review had led to the annulment of Vero Volleyball&#8217s point, with the awarding of the same to the Pontine team. The Consortium club, in particular, disputed the timing of the video-check request.

“Examination of the official documents, in concert with the identification of the rules governing the procedures for access to proceedings on application, as well as those that oversee the governance of the Video-Check request procedure, convince this Office of the existence of a twofold profile of inadmissibility of the proposed application, both, in prevalence, with regard to the rite, and, for what it may be worth on the however to be decided on the rite, also preliminarily on the merits” reads the note of the Volleyball League.

“As for the rite, having recalled what is strictly provided by paragraphs 3 and 4 of Article 23 of the Jurisdictional Regulations regarding the subjective and objective requirements necessary for the regular formalization and perfection of the first phase of the petition against the result of the competition, as well as the peremptoriness of the terms indicated therein and referred to in the seventh paragraph below, the petition, as said, appears prima facie inadmissible”.

“Specifically, it appears from the official records, the primary source of evidence, that the complaining club, having concluded the match at 8:35 p.m., confirmed the pre-announcement of petition at 8:52 p.m. and, that is, beyond the peremptory deadline referred to in the fourth paragraph of Article 23 of the Jurisdictional Regulations. As for the reason of inadmissibility on the merits of the grievance, without prejudice to the prevalence and absorbing character of the deduced inadmissibility on the rite, we simply refer to the regulatory provision in Article 16 of the Video-Check Regulations, which sanctions the inadmissibility of petitions aimed at censuring the referee’s decisions on the use of the tool of ex-post verification of game actions” concludes the League in the reasons that led to the rejection of the appeal.
